Section 52 Exclusion

Domestic purposes

Personal data held by an individual and-

(a) concerned only with the management of his personal, family or household affairs; or

(b) so held only for recreational purposes, are exempt from the provisions of the data protection principles, Parts IV and V and sections 36 and 38(b).

In other words, Personal data collected and held by the Society in the ordinary course of its business (i.e. only for recreational purposes) are exempt from the provisions of the data protection principles, Parts IV and V and sections 36 and 38(b).

Personal data collected and held by the Society in the ordinary course of its business (i.e. only for recreational purposes) are exempt from the provisions of the data protection principles, Parts IV and V and sections 36 and 38(b).

To avoid some busybody asking the Society for its Personal Data Policy as we are operating on a non commercial basis and for recreational purpose only.

For administration purpose, the Society collects Personal Data (currently name, email address) from its members and may have retained additional personal data of our members (such as the results of the member's competitions, take photos of our gaming activities at our meeting).

Collecting and retaining such data are necessary because the Society cannot provide club service to our members without these data.

e.g. name and email address for circulation of newletters and organising meetings, photos to identifying who are our members and for promoting the Society to the public and recording our gaming activities, etc.

The current Personal Data Privacy Ordinance allows data subjects to request the data owners and data users to do certain things and some of these duties and responsibilties are quite troublesome and might involves a lot of administration costs for the Society. Therefore, it is better for the Society to disclose such fact (i.e. we are exempt from Personal Data Privacy Ordinance) in our forum to avoid possible dispute with the data subject and to eliminate any expectation gap.
